1. Website owner, the offering, and binding of Terms
1.1 This website is owned and operated by Scott & Macrae Ltd. trading as Dalmeny Designs (“we”, “us” or “our”).
1.2 These Terms set forth the terms and conditions under which you may use our website and services as offered by us.
1.3. This website offers visitors the ability to browse and purchase products designed and made by Dalmeny Designs.
1.4 By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
1.5 In order to use our website and/or receive our services, you must be of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement.
1.6 You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
2. Key commercial Terms
2.1 When buying an item, you agree that:
2.1.1 You are responsible for reading the full item listing before making a commitment to buy it
2.1.2 You enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
2.2 The prices we charge for our products are listed on the website.
2.3 We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.
3. Return and refund policy
3.1 We can accept returns for up to 30 days after the date of delivery.
3.2 If you wish to make a return please contact us and we will provide a return address.
3.3 The postage cost of returning the item is the responsibility of the customer.
3.4 We would highly recommend sending the item via a tracked courier service and suggest using DPD Local.
3.5 We cannot be held responsible for returns sent via an untracked service which are either delayed or undelivered.
3.6 Provided the item is returned in a resaleable condition, along with all its original packaging, we can arrange for an exchange, or issue a refund to the original payment method.
3.7 We are not able to accept returns for bespoke items which are built to a custom size or using a custom fabric.
3.8 Products can be returned only in the country in which they were originally purchased.
4. Retention of right to change offering
4.1 We may, without prior notice, change products; stop providing products or any features of the products we offer.
5. Warranties & responsibility for services and products
5.1 When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product.
5.2 We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.
6. Ownership of intellectual property, copyrights and logos
6.1 The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Dalmeny Designs.
6.2 Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
7. Indemnification
7.1 You agree to indemnify and hold Dalmeny Designs harmless from any demands, loss, liability, claims or expenses (including lawyers’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the products or services offered on the website.
8. Limitation of liability
8.1 To the maximum extent permitted by applicable law, in no event shall Dalmeny Designs, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service or products.
8.2 To the maximum extent permitted by applicable law, Dalmeny Designs assumes no liability or responsibility for any;

11. Preference of law and dispute resolution
11.1 These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United Kingdom, without respect to its conflict of laws principles.
11.2 Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Edinburgh.
11.3 The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

4.3 All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
